Acceptable Use Policy

1. Overview
This Acceptable Use Policy ("AUP") governs your use of the Memrly application and services. It supplements the Memrly Terms of Service and Privacy Policy. By using Memrly, you agree to comply with this policy.
We are committed to maintaining a safe, respectful platform for sharing personal memories. This policy defines what content and behavior are not permitted on Memrly.
2. Prohibited Content
You may not upload, share, or distribute any of the following content through Memrly:
2.1 Child Sexual Abuse Material (CSAM) — Zero Tolerance
Any content that depicts, promotes, or facilitates the sexual exploitation or abuse of minors is strictly prohibited. This includes, but is not limited to:
- Photographs, videos, or digitally generated images of child sexual abuse
- Content that sexualizes minors in any way
- Content that facilitates grooming or exploitation of minors
Memrly maintains an absolute zero-tolerance policy for CSAM. Any confirmed CSAM results in:
- Immediate and permanent account termination (no warnings)
- Preservation of evidence and reporting to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline
- Reporting to relevant law enforcement authorities
- Cooperation with any subsequent investigation
2.2 Non-Consensual Intimate Images
Content depicting nudity or sexual acts of any person without their explicit consent, including content commonly known as "revenge porn" or non-consensual pornography.
2.3 Violence and Gore
Content that depicts, promotes, or glorifies:
- Graphic violence against people or animals
- Gore, mutilation, or graphic injury
- Threats of physical harm against specific individuals or groups
2.4 Hate Speech and Discrimination
Content that attacks, demeans, or incites violence or hatred against individuals or groups based on:
- Race, ethnicity, or national origin
- Religion or belief
- Gender, gender identity, or sexual orientation
- Disability
- Age
- Any other protected characteristic under applicable law
2.5 Terrorism and Extremism
Content that promotes, supports, or glorifies terrorism, terrorist organizations, or violent extremist ideologies.
2.6 Illegal Content
Content that facilitates, promotes, or depicts illegal activity, including but not limited to:
- Drug trafficking or illegal substance distribution
- Weapons trafficking
- Fraud or financial crimes
- Content that violates export control laws
2.7 Spam and Misleading Content
- Bulk unsolicited messages or invitations
- Content designed to deceive, mislead, or defraud other users
- Fake accounts or impersonation (see Section 3)
2.8 Copyright-Infringing Material
Content that infringes on the intellectual property rights of others, including copyrighted photographs, videos, or other media for which you do not hold the necessary rights or licenses.
3. Prohibited Conduct
In addition to content restrictions, the following behaviors are prohibited on Memrly:
3.1 Harassment and Bullying
- Targeted harassment, bullying, or intimidation of other users
- Repeated unwanted contact after being asked to stop
- Publishing private information of others without consent (doxxing)
3.2 Impersonation
- Creating accounts that impersonate another person or entity
- Misrepresenting your identity or affiliation
3.3 Unauthorized Access
- Attempting to access accounts, systems, or data without authorization
- Exploiting vulnerabilities in the Memrly application or infrastructure
- Scraping, crawling, or using automated tools to extract data from the Service
3.4 Circumventing Security Features
- Bypassing or attempting to circumvent screenshot prevention controls
- Disabling or interfering with content moderation systems
- Using modified versions of the Memrly application
3.5 Ban Evasion
- Creating new accounts to circumvent a previous suspension or termination
4. Automated Content Detection
To maintain platform safety and comply with legal obligations, Memrly employs automated content detection systems:
- Uploaded photos and videos may be scanned by artificial intelligence and machine learning technologies to identify prohibited content
- These systems are designed to detect CSAM, graphic violence, and other content that violates this policy
- All content flagged by automated systems is reviewed by a human moderator before any enforcement action is taken against your account
- Automated detection operates in accordance with our Privacy Policy
5. Enforcement
5.1 Enforcement Actions
When a violation of this policy is confirmed, we may take one or more of the following actions:

| First violation (non-severe) | Content removed. Written warning issued via email. |
| Second violation | Temporary account suspension (7-30 days depending on severity). |
| Severe or repeated violations | Permanent account termination. |
| CSAM | Immediate permanent termination. Reported to NCMEC and law enforcement. No warnings. |
We reserve the right to escalate enforcement at any time based on the severity of the violation. The enforcement levels above are guidelines; we may take more severe action for particularly egregious violations even on a first offense.
5.2 Content Removal
We may remove content that violates this policy without prior notice. Where possible, we will notify you of the removal and the reason.
5.3 Account Suspension
During a temporary suspension:
- You cannot access the Service
- Your content remains stored but is not accessible to you or your album members
- Your subscription continues to be billed unless you cancel through your app store
5.4 Account Termination
Upon permanent termination:
- Your account and all associated content are deleted following the retention periods described in our Privacy Policy
- Any pending creator monetization payouts are handled per the Creator Monetization Terms
- You may not create a new account
6. Reporting Violations
If you encounter content or behavior that violates this policy:
- In-app: Use the report button available on photos, comments, and user profiles
- Email: Contact support@memrly.com with details of the violation, including screenshots if possible
We review all reports and take action as appropriate. Reports are treated confidentially — we do not disclose the identity of reporters to the reported user.
7. Appeals
If you believe enforcement action was taken against your account in error, you may appeal within 14 days of receiving the enforcement notice:
- Send your appeal to support@memrly.com
- Include your account email, the enforcement action taken, and your explanation
- We will review your appeal and respond within 14 days
- Appeal decisions are final
Appeals are not available for confirmed CSAM violations.
8. Cooperation with Law Enforcement
We comply with valid legal process, including court orders, subpoenas, and search warrants issued by courts of competent jurisdiction. We may disclose user information to law enforcement when:
- Required by law
- Necessary to protect the safety of any person
- Necessary to prevent imminent harm or illegal activity
- We have a good-faith belief that disclosure is required to comply with legal obligations
We are legally required to report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate with subsequent law enforcement investigations.
9. Changes to This Policy
We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance.
